1. About These Terms
These Terms of Use ("Terms") govern your access to and use of racehorses.au (the "Site"), operated in Australia. By browsing the Site, submitting a listing, or contacting an advertiser through the Site, you agree to these Terms. If you do not agree, please do not use the Site.
2. What the Site Is
Racehorses.au is a directory and marketplace connecting people interested in racehorse ownership with racehorses for sale, ownership shares and syndication opportunities, and racing industry businesses such as trainers, syndicators, bloodstock agents and service providers. We are not a licensed bloodstock agent, financial adviser or racing club, and we are not a party to any transaction, agreement or arrangement made between users of the Site.
3. Listings and User Submissions
Businesses, sellers and syndicators may submit listings for publication on the Site. By submitting a listing, you confirm that:
- the information you provide is accurate and not misleading;
- you have the right to advertise the horse, share, or business described;
- you will comply with all applicable Australian laws and racing industry rules, including those of your state or territory principal racing authority; and
- you are responsible for keeping your listing up to date and removing it once it is no longer current.
We may review, edit, decline, or remove any listing at our discretion, including listings that appear inaccurate, non-compliant, or inappropriate for the Site.
4. No Endorsement or Guarantee
Listings on the Site are supplied by third parties. We do not verify horse ownership, veterinary condition, racing history, business licensing, or financial standing of any advertiser, and we do not endorse, guarantee or warrant any listing, horse, share, syndicate or service. Any decision to buy, lease, take a share in, or engage a business found through the Site is made entirely at your own risk and discretion. We strongly recommend independent veterinary, legal and financial advice before entering into any racehorse ownership or syndication arrangement.
5. Fees and Featured Listings
Some listing tiers, including Featured placement, may be offered for a fee as described on our Advertise page. Fees, where applicable, are payable in Australian dollars and are non-refundable once a listing has gone live, except where required by Australian Consumer Law.
6. Intellectual Property
The Site's design, branding, logo and original content are owned by Racehorses.au and may not be copied or reproduced without permission. Content you submit (such as listing text and photographs) remains yours, but by submitting it you grant us a licence to display it on the Site and in related promotional material.
7. Limitation of Liability
To the maximum extent permitted by law, Racehorses.au excludes all liability for any loss or damage arising from your use of the Site, reliance on any listing, or any transaction or dealing with another user or advertiser. Nothing in these Terms excludes any guarantee, warranty or other right that cannot lawfully be excluded under the Australian Consumer Law.
8. Governing Law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
9. Changes to These Terms
We may update these Terms from time to time. Continued use of the Site after changes are posted means you accept the updated Terms.
